Elderly Abuse Insurance Claims: When your insurance company wrongfully denies your claim, or withholds insurance benefits that you are entitled to and you are over the age of 70 you have additional protection under the Elder Abuse and Dependent Adult Civil Protection Act (Welf. & Inst. Code, § 15600 et seq.)
This act was enacted to provide for the “private, civil enforcement of laws against elder abuse and neglect. The benefit of this act is that it allows for treble damages (Three times your actual financial loss) to be recovered against the insurance company that wrongfully denied your claim or wrongfully withheld your insurance benefits.
A denial or delay in paying an insurance claim could cause you an extreme financial hardship. You don’t have to accept what your insurance company is offering you. You don’t have to accept your claim being denied.
